Foreclosure Defense We do not require a preservice retainer to cover the total cost of your case. We understand that each of our clients has financial difficulty and would be unable to come up with a large lump sum. We have designed a monthly retainer payment plan which is customized based on the NPV Analysis we conduct for each client. Since the bank will not accept mortgage payments during the foreclosure process your monthly retainer payments will be equal to the modified mortgage payment we are requesting of the bank. These monthly payments will be held in an Illinois Attorney’s Trust Account and we will bill all costs and fees against this retainer account. Funds remaining in the retainer account when the case is dismissed will be refunded to the client immediately. Loan Modification Our fee for a loan modification is $1,800 (Payment plans are available). $800 is a nonrefundable processing fee. The remaining $1,000 is placed in an Interest Only Lawyer Trust Account, an IOLTA, and is not earned or withdrawn until and unless a loan modification is secured for your home. In this infrequent case that we are unable to secure a loan modification, a prompt refund of $1,000 is made. Bankruptcy We provide free initial consultations in order to evaluate whether bankruptcy is an option for a client's financial circumstances. Attorneys fees for a bankruptcy case vary depending on the complexity of the case. The filing fee to the Clerk of the United States Bankruptcy Court is $306.00 for a Chapter 7 and $281.00 for a Chapter 13. All persons filing a bankruptcy case are required to take a certified credit counseling class before the case can be filed, in addition to a mandatory post filing debtor education course. The fees for those courses are approximately $25.00 per course, but vary depending on the provider. |
